1. Purpose and scope
These terms govern the sale of vehicles, trucks, semi-trailers, construction machinery, equipment and supplies, as well as the construction, transport and supply services provided by Holding Deal Africa to business customers.
Any order implies unreserved acceptance of these terms, which prevail over the customer's purchasing conditions unless otherwise agreed in writing.
2. Quotes and orders
The information in the online catalogue is indicative and does not constitute a firm offer. Only the quote drawn up by Holding Deal Africa binds the parties as to the specifications, price, lead time and delivery terms of the equipment.
Quote validity: to be completed: validity period. The order becomes firm on receipt of the signed quote and of the agreed deposit.
3. Prices
Prices are expressed in CFA francs. They are exclusive of taxes, registration costs and delivery preparation costs, unless otherwise stated in the quote.
The price of equipment depends in particular on the quantity ordered and the place of delivery: this is why the catalogue shows “price on request” rather than a fixed amount.
4. Payment

No payment is collected through this website: payments are made directly to Holding Deal Africa, in accordance with the terms set out in the quote.
5. Retention of title
The equipment remains the property of Holding Deal Africa until the price has been paid in full. Risk, however, passes as soon as the equipment is handed over to the customer or to its carrier.
6. Delivery
Indicative lead time: to be completed: delivery lead time. Lead times run from receipt of the deposit and the lifting of any administrative conditions.
A delay in delivery cannot give rise to cancellation of the order or to compensation where it results from force majeure, a delay in sea freight, a customs formality or an act of the customer.
7. Acceptance and claims
The customer checks the condition and conformity of the equipment on receipt. Any reservation must be made in writing within to be completed: claim period, together with the relevant photographs.
8. Warranty

The warranty does not cover normal wear and tear, consumables, or damage resulting from lack of maintenance, overloading, use not in line with the purpose of the equipment, or work carried out by an unauthorised third party.
9. Liability
The liability of Holding Deal Africa is limited to the amount of the order concerned. It does not extend to indirect losses, in particular loss of business, site downtime or loss of earnings.
10. Personal data
The processing of information provided with a request or an order is described in our privacy policy.
11. Governing law and disputes
These terms are governed by Ivorian law. The parties will endeavour to settle any dispute amicably. Failing agreement, the Abidjan Commercial Court shall have sole jurisdiction.
